These Terms and Conditions govern your use of our online courses and services. Please read these terms carefully before accessing or using our courses.
1. Acceptance of these Terms and Conditions
By accessing our services and enrolling into our Communications & Slide Writing Academy or other online courses / offerings, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you should not use our online courses and offers.
By agreeing to the cookies (see the provisions in our privacy policy ), you agree to the respective tracking by them.
2. Registration and Access to Courses
a) To use our online courses, you must register on the portal teachable.com and create a user account. You agree to the Terms and Conditions provided by teachable.com, under which all information provided by is accurate, complete and up-to-date. b) You are responsible for maintaining the confidentiality of your account information and are liable for all activities that occur under your account. Please do not share your login information with third parties.
c) We reserve the right to deny or restrict your access to our online courses at any time and for reasonable cause.
3. Contractual relationship with teachable.com
All online offerings of Firm Learning, including the Communications & Slide Writing Academy, are sold by teachable.com (Teachable, Inc.). Teachable.com acts as seller of this course and is the right contact partner for all questions about invoicing or related topics. Firm Learning (Firm Learning GmbH) is not the seller of these offerings. In case any provisions of the Firm Learning terms & conditions (terms of use) conflict with the teachable.com terms of use, the terms & conditions of Firm Learning will apply and replace the provisions of teachable.com.
4. Users of the Courses
a) The acquisition of the Communications & Slide Writing Academy via teachable.com entitles a natural person to consume the contents of this course. Given access to the Academy or any other offerings to other natural persons is not permitted.
b) The online courses are generally aimed at natural persons and do not entitle legal entities (companies) to adopt the training content as their own (see also the "Intellectual Property" section). If you are interested in a company training, please contact [email protected].
5. Contents of the Courses
a) In principle, the online courses (including the Communications & Slide Writing Academy) are delivered exclusively electronically. This means that there will be access to the training content that has already been prerecorded and uploaded as on-demand video. These are "Electronically Supplied Services" (ESS). There is no legal entitlement to live training of the presenter, be it electronically or through personal training. In the theoretical case that there is a service that has a live component, i.e. a trainer contacts users in a live session, this is not part of the offer and there is no entitlement to it from the purchase of the online course. This includes access to any types of online communities or related offerings.
b) The contents of the courses are secret and may not be disseminated orally, in writing or electronically. See also the section: "Intellectual Property."
6. Intellectual Property
a) All content, materials and resources provided in our online courses remain our intellectual property or that of our licensors and are protected by applicable copyright, trademark and other intellectual property rights.
b) You are granted a limited, non-exclusive license to access and use our online courses for your personal, non-commercial use. You may not copy, modify, distribute, publish, transmit, sell, license, or create derivative works of any Content. In particular, you are not permitted to use the course materials as training material for internal company purposes.
7. Disclaimer
a) We strive to provide accurate and up-to-date information in our online courses. Nevertheless, we assume no liability for the accuracy, completeness or timeliness of the content provided.
b) We accept no responsibility for any damage or loss resulting from the use of our online courses, including direct, indirect, incidental or consequential damages.
8. DamagesÂ
There are no claims for damages accepted by users against Firm Learning due to the content of the online courses or the content of the website and its subdomains: https://firmlearning.com
9. Changes and Termination
a) We reserve the right to change these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our online courses after such changes will be deemed to be your acceptance of the modified terms.
b) We may terminate or suspend your access to our online courses at any time without prior notice if you violate these Terms and Conditions.
10. Right of Revocation, Withdrawal or Refund
In principle, there is no right of revocation / right of withdrawal / refunds for the purchase of digital content, as is the case with the purchase of an online course.
However, we will accept refund requests if these are made within 48 hours of purchase, and if not more than 30% of the content of this Academy have been consumed yet, as determined by the records provided by the Teachable platform.
At the discretion of Firm Learning, refund requests meeting these requirements can be denied, if Firm Learning has cause to assume that the purchase has been made in bad faith, e.g., the Academy has only been accessed to steal the content, to gather market intelligence by a competitor, or to prepare legal action against Firm Learning.
As teachable.com is the seller of all digital products offered by Firm Learning, including the Communications & Slide Writing Academy, Firm Learning will forward accepted refund requests to teachable.com, using a process that teachable.com provides. Firm Learning can ultimately not guarantee the success of the refund, and cannot be made liable for any damages in this regard. In case any provisions in this section conflict with the teachable.com terms of use, the terms & conditions of Firm Learning will apply and replace the provisions of teachable.com.
11. Privacy
Please refer to our privacy policy for the information in accordance with Art. 12 et seq. GDPR.
12. Applicable Law and Jurisdiction
These Terms and Conditions shall be governed by the applicable laws of Germany, except as otherwise provided by intergovernmental agreements or individual party agreements between you and us.
For any dispute arising in connection with these Terms, the parties agree to submit to the exclusive jurisdiction of the courts of the Regional Court of Munich, Germany.
13. Expiration of Rights of Use
At the end of 12 months after the purchase of the course via the platform, the license of use will be revoked. After that, another license can be purchased again.
14. Miscellanea
If you purchase the online course, you agree that you will refrain from expressing false facts about the content, the person providing the course and the services of Firm Learning or deliberately concealing true facts during the period of offering the online courses of Firm Learning. You agree that you will refrain from intentionally or through gross negligence causing damage to the provider, the company Firm Learning and the services of Firm Learning. In the event of violations of any of these aforementioned provisions, we reserve the right to claim damages for each intentional or grossly negligent act of the user.
